The agreement between you and us for using Jarmer. We've kept it as plain as we can; the short version comes first.
The short version
These terms are between you and Functioning Labs LLC, the company that makes Jarmer. Not Apple.
A household is one to four people. Everyone in it sees what's shared; private things stay private (the privacy policy says exactly what).
What you put into Jarmer is yours. You let us store and process it only to run Jarmer for you and your household.
AI help is optional, and it only suggests. It can be wrong, so check anything that matters.
Jarmer isn't medical or mental-health care. The journal is for you, not a clinical tool.
Jarmer Plus is $4.99 a month or $34.99 a year in the US, billed by Apple. One purchase covers everyone at home. It renews until you cancel it in your Apple Account settings.
If Plus ends, nothing is deleted. You just can't add past the Free limits.
Be decent, don't break the law or the service, and these terms will mostly stay out of your way.
1. Who these terms are with
These Terms of Use are an agreement between you and Functioning Labs LLC ("we", "us", "our"), which makes Jarmer. They cover the Jarmer app for iPhone and Apple Watch (with its widgets, Live Activities, notifications and Siri shortcuts), the website at jarmer.app and the account page at jarmer.app/account, together "Jarmer".
By creating an account or using Jarmer, you agree to these terms and to our privacy policy, which explains what we do with your information. If you don't agree, please don't use Jarmer.
These terms are between you and Functioning Labs LLC only, not Apple. We, not Apple, are solely responsible for Jarmer and its content. Section 19 has the rest of what Apple asks us to say.
2. Who can use Jarmer
You need to be at least 13 years old (or the minimum age where you live) to use Jarmer. If you're under 18, or under the age of majority where you live, a parent or guardian needs to agree to these terms for you. You can't use Jarmer if the law where you are bars you from it.
3. Your account
You sign in with Apple, Google or your email address, through our sign-in provider, Clerk. Give us a name people at home will recognize, keep your sign-in to yourself, and tell us at support@jarmer.app if you think someone else has got into your account. You're responsible for what's done with your account. One account is for one person.
4. Households
A household holds one to four people. You join one by setting it up or by using an invite. You can be in one household at a time.
Everyone in a household sees what's shared in it: chores, lists, the house manual, Moments, together goals and the rest, including anyone who joins later. Private tasks, personal goals and routines stay with their owner unless they choose to show them, and your journal is only ever yours. The privacy policy has the details.
Only invite people you want to share your home's things with, and only add things about other people that you're entitled to share.
Shared things belong to the household. If you leave or delete your account, they stay with the people who are still there, and your private things are deleted (how that works).
Anyone in a household can change its shared settings. Problems between the people in a household are for them to sort out; we can't take sides, though we'll help with the account side where we can.
5. Your content
What you put into Jarmer (tasks, lists, notes, journal entries, photos, recipes and everything else) stays yours.
So we can run Jarmer, you give us a worldwide, non-exclusive, royalty-free permission to store, copy, process, send and show your content: to sync it to your devices and to the people in your household it's shared with, to send it to the companies that help us run Jarmer (listed in the privacy policy), including AI providers when everyone at home has said yes to AI help, and to keep Jarmer working, safe and improving. We don't use it for anything else. The permission ends when your content is deleted, apart from copies kept for a limited time as the privacy policy describes (backups, for instance) and anything shared with your household that stays there.
You're responsible for your content and promise you have the right to add it, including photos of other people and things you import from elsewhere. If you import a recipe or save a link, keep the credit to its source, and use it for your household, not to republish.
If you send us ideas or feedback, we may use them without owing you anything. Thank you.
6. Questions on guides
With a Jarmer account you can ask about a guide on jarmer.app or answer someone. Those posts are public. For them, the permission in section 5 also covers showing them to anyone who visits, under your first name and last initial, for as long as they're up.
Keep it kind and useful: questions and answers about the guide, in plain words. No links, ads or selling, nothing hateful, harassing or explicit, nothing that isn't yours to share (including other people's personal details), and nothing presented as professional advice. Every post is checked automatically before it shows, and a first post, or anything the check flags, waits for one of us to look.
We read what's reported, and we may hide or remove any post, and stop an account from posting, when we think it breaks these terms. Answers from other people are their own view, not ours, and come with no promise that they're right.
7. Using Jarmer fairly
Please don't use Jarmer to:
harass, threaten, stalk, control or harm anyone, including people you live with;
break the law, or store or share anything illegal, or anything that infringes someone else's rights;
get into someone else's account or household without their permission, or get around a privacy setting;
disrupt or overload Jarmer, probe it for weaknesses without our permission, or get around its limits (including the Free limits and the AI allowance);
copy, scrape, resell or reverse-engineer Jarmer, except where the law allows it regardless of this term;
use automated means (scripts, bots) to create accounts or send requests, other than Home Assistant as Jarmer supports it;
use AI help to make content that's harmful, deceptive or illegal.
We may remove content or limit, suspend or end an account that does these things (section 14).
8. AI help
AI help is optional. It's on for a household only while everyone in it has said yes, and anyone can turn it off for everyone by saying no (in the app, or at jarmer.app/account).
What AI makes (sorted captures, broken-down tasks, plans, drafts, filled lists, looked-up notes, imported recipes, answers to How do I…?) is a suggestion for you to review. Nothing it suggests is applied until you choose it, and everything has Undo.
AI can be wrong, out of date or incomplete, even when it sounds sure, and a looked-up answer is only as good as its sources. Check anything that matters (dates, amounts, safety, money, legal or official requirements) before you rely on it.
AI output isn't professional advice of any kind (section 9).
Each household has a monthly AI allowance, on Free and Plus alike. When it's used up, AI help rests until the 1st; everything else keeps working.
Tap Report on any AI answer that's wrong or inappropriate, and we'll look at it.
9. Not medical or professional advice
Jarmer helps a household keep track of things to do and remember. It isn't a medical device and doesn't give medical, mental-health, legal, financial or other professional advice.
The journal is a private place for your own check-ins and notes. It isn't a clinical or mental-health tool: it doesn't assess, diagnose or treat anything, and a mood check-in is never shared with anyone or escalated to anyone.
Exercise and step goals are reminders, not a fitness or health program. Check with a professional before starting something new.
Guides, calculators and Moments (moving, hosting, a trip) are general information. They don't include legal or official deadlines, and your situation may differ.
If you're in crisis or thinking about harming yourself, contact your local emergency services. In the US, you can call or text 988.
10. Jarmer Plus
What it is
Jarmer is free to use, with limits on some things (such as five recurring chores). Jarmer Plus is an auto-renewing subscription that lifts those limits and adds the planning features. One purchase unlocks Plus for everyone in your household. What's in Free and Plus is shown in the app and on jarmer.app/pricing.
Price and billing
In the US, Jarmer Plus costs $4.99 a month or $34.99 a year, plus any tax. Prices elsewhere are shown in the App Store, in your currency, before you buy. Jarmer Plus is bought in the app and billed by Apple to your Apple Account: payment is charged when you confirm the purchase. There's no lifetime option and no free trial.
Renewal and cancelling
Your subscription renews automatically for the same period at the then-current price unless you cancel it at least 24 hours before the end of the current period. Your Apple Account is charged for the renewal within the 24 hours before the current period ends. Manage or cancel your subscription in your Apple Account settings (on iPhone: Settings → your name → Subscriptions) or at apps.apple.com/account/subscriptions. Cancelling stops the next renewal; Plus carries on until the end of the period you've paid for.
Refunds
Apple handles payments and refunds for App Store purchases under its own terms. To ask for a refund, go to reportaproblem.apple.com. We can't issue refunds for purchases Apple billed. Nothing in these terms takes away a refund right the law gives you.
Whose subscription it is
The person who buys Plus is the one Apple bills, and the subscription is theirs to manage. If they leave the household or delete their Jarmer account, Apple keeps billing them until they cancel, and the household keeps Plus while it's paid for. Deleting your account doesn't cancel a subscription: your subscription is billed by Apple and keeps renewing until you cancel it in your Apple Account settings.
If Plus ends
Nothing is deleted or paused. Everything you've made keeps working. Adding more past the Free limits stops until you're back under them (archiving something makes room), and the Plus-only features stop.
The first one's on us
On Free, each headline Plus feature (such as planning a goal, fitting a Moment, drafting, looking something up, filling a list, drafting the weekly reset or importing a recipe) can be used once per household, free. A free go is used only when it gives you something. It doesn't start a subscription or a trial, and which features have one may change.
Plus on us
We sometimes give a household Plus for free (during the beta, for instance). It lasts until the date we tell you, or until we end it with notice, and it never stops a purchase from working.
Price changes
We may change prices. A change won't apply to a period you've already paid for. Apple will tell you before a new price applies to your subscription and, where the law or Apple's rules require it, ask you to agree first; if you don't, the subscription ends at the end of the current period.
11. Free features and changes to Jarmer
Jarmer keeps changing as we learn what helps. We may add, change or remove features, including what's in Free and Plus and the Free limits, and we may set reasonable limits to keep Jarmer working for everyone. Some things stay free on purpose: joining a household, notifications and the lock screen, Now, capture, the grocery list, the journal, exporting your data and deleting your account. If a change takes away something you pay for, we'll tell you ahead of time.
We work hard to keep Jarmer running, but it may sometimes be unavailable, for maintenance or for reasons outside our control. Changes you make offline are kept on your phone and sync when it reconnects.
12. Other services
Jarmer works with things that aren't ours: Sign in with Apple and Google, the App Store, Apple Health, your calendars, Maps, Home Assistant, and the websites guides and looked-up notes link to. Your use of those is under their own terms, and we aren't responsible for them. You must also follow the terms of any service you use to reach Jarmer, such as your mobile carrier's.
13. What's ours
Jarmer itself (the app, the website, the guides, the design and the code) belongs to Functioning Labs LLC and is protected by copyright and other laws. We give you a personal, limited, non-exclusive, non-transferable, revocable license to use the Jarmer app on Apple-branded devices you own or control, as Apple's Usage Rules allow (section 19), and to use the website, for your own household and not commercially. These terms don't give you any other rights in Jarmer.
You're welcome to share a link to a guide, or a short quote from one with credit and a link back.
Jarmer™ and Functioning Human™ are trademarks of Functioning Labs LLC. You may not use them without our written permission.
14. Ending things
You can stop using Jarmer any time, and delete your account in the app (Me → Settings → Delete my account) or at jarmer.app/account. Remember to cancel any subscription in your Apple Account settings too.
We may suspend or end your access if you seriously or repeatedly break these terms, if the law requires it, or to protect people or Jarmer. Unless the law or safety stops us, we'll tell you why and give you a chance to export your data. If we ever stop offering Jarmer altogether, we'll tell you at least 30 days ahead, so you can export everything, and we'll stop selling Plus so nothing renews.
The sections that by their nature should last after this agreement ends (such as 5, 12 and 14 to 20) do.
15. Disclaimers
Jarmer is provided "as is" and "as available". To the fullest extent the law allows, we make no promises beyond those in these terms, and we disclaim all implied warranties, including of merchantability, fitness for a particular purpose, accuracy and non-infringement. We don't promise that Jarmer will be uninterrupted or error-free, that a reminder or notification will always arrive on time, or that AI output will be accurate.
Jarmer helps you remember and decide; it doesn't replace your own judgement. Don't rely on it alone for anything where a missed reminder could cause harm, such as medication, safety checks or legal and payment deadlines.
Some places don't allow these disclaimers, so they may not all apply to you. They never limit your rights as a consumer under laws that can't be set aside by agreement.
16. Limits on liability
To the fullest extent the law allows, Functioning Labs LLC and the people who work with us won't be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, data, use or goodwill, arising from or relating to Jarmer or these terms, even if we were told they were possible. Our total liability for all claims relating to Jarmer or these terms is limited to the greater of what you paid for Jarmer Plus in the 12 months before the claim and US$50.
We're not responsible for delays or failures caused by things outside our reasonable control, such as outages at the companies we rely on, networks, or natural events.
Nothing in these terms limits liability that can't be limited by law, such as for death or personal injury caused by negligence, or for fraud. If you live in the EU or the UK, we're responsible for foreseeable loss or damage caused by our breach of these terms or our lack of reasonable care.
17. If you break these terms
To the extent the law allows, if someone makes a claim against us because of content you added or because you broke these terms or the law, you'll cover our reasonable costs of dealing with it. This doesn't apply to consumers where local law doesn't allow it.
18. Governing law and disputes
If something's wrong, please write to support@jarmer.app first; most things can be sorted out that way.
These terms are governed by the laws of the Commonwealth of Massachusetts, USA, without regard to its conflict-of-law rules. Any dispute will be resolved in the state or federal courts located in Massachusetts, and you and we agree to their jurisdiction.
If you're a consumer living outside the US, you also keep the protection of the mandatory laws of the country you live in, and you can bring a claim in your local courts.
Acknowledgement. These terms are between you and Functioning Labs LLC only, not Apple. Functioning Labs LLC, not Apple, is solely responsible for the Jarmer app and its content.
Scope of the license. Your license to the app is limited to a non-transferable license to use it on Apple-branded products that you own or control, as permitted by the Usage Rules in Apple's Media Services Terms and Conditions, except that it may also be accessed and used by other accounts associated with you through Family Sharing or volume purchasing.
Maintenance and support. We, not Apple, are solely responsible for providing maintenance and support for the app, as described in these terms or as the law requires. Apple has no obligation at all to provide maintenance or support for it. For support, write to support@jarmer.app or visit jarmer.app/help.
Warranty. We're solely responsible for any product warranties, whether express or implied by law, to the extent they aren't effectively disclaimed. If the app fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the app to you. To the maximum extent the law allows, Apple has no other warranty obligation for the app, and any other claims, losses, liabilities, damages, costs or expenses attributable to a failure to conform to a warranty are our sole responsibility.
Product claims. We, not Apple, are responsible for addressing any claims by you or a third party relating to the app or your possession or use of it, including (a) product liability claims; (b) any claim that the app fails to conform to any applicable legal or regulatory requirement; and (c) claims arising under consumer protection, privacy or similar laws, including in connection with the app's use of the HealthKit framework. These terms don't limit our liability to you beyond what the law allows.
Intellectual property claims. If a third party claims that the app or your possession and use of it infringes their intellectual property rights, we, not Apple, are solely responsible for investigating, defending, settling and discharging that claim.
Legal compliance. You confirm that you're not located in a country that is subject to a US Government embargo or that the US Government has designated as a "terrorist supporting" country, and that you're not listed on any US Government list of prohibited or restricted parties.
Developer name and address. Questions, complaints or claims about the app go to Functioning Labs LLC, Boston, MA 02135, USA, at support@jarmer.app.
Third-party terms. You must comply with any applicable third-party terms when using the app, such as your wireless data service agreement.
Third-party beneficiary. Apple and Apple's subsidiaries are third-party beneficiaries of these terms, and once you accept them, Apple will have the right (and will be deemed to have accepted the right) to enforce them against you as a third-party beneficiary.
20. Changes to these terms
We may update these terms as Jarmer changes or the law does. If a change matters, we'll tell you in the app before it takes effect and change the date at the top. If you keep using Jarmer after that, you're agreeing to the new terms; if you don't agree, you can stop and delete your account. A change won't apply to a dispute that arose before it.
21. The legal odds and ends
These terms and the privacy policy are the whole agreement between you and us about Jarmer.
If part of these terms can't be enforced, the rest still applies, and that part is applied as far as the law allows.
If we don't enforce a term straight away, we haven't given up the right to.
You can't transfer these terms to anyone else. We may transfer them as part of a merger, sale or reorganization, and your rights under them stay the same.
We may send notices in the app, by email to the address on your account, or on this page.
